Husband has cheated on me despite being married. have proof.

My husband has cheated on me. He goes to call girls .What action should I take? I also has proof against him.And if I filed a case then till where I'll get justice, duration of the case.Also is there any strict law/punishment for this cause.And if want to take divorce what compensation I will get what is the procedure,& duration?

You can file for divorce against your husband under section 13 of the Hindu Marriage Act. You can also file a case for maintenance against him under section 125 of Cr p. c. The time cannot be explained as it can take any time more then 1 year. You will have to file it before the family court it's better to get it through a lawyer

Firstly dont go for Divorce, it is like giving your game away into his hands. He right now wants to go away from you and you make it easier as you file for divorce(thats what your husband needs)
File a case of maintenance u/s 125Cr.PC, once you do that money will start coming your way by way of interim maintenance, once any man's hard earned money goes away from his pocket he is bound to stumble upon things and agree to finish of the matter but this time it would be on your terms and your compensation.
I mean to say the ball will be in your court.
Secondly in addition to this you should also be filing a Complaint in the Local Police Station against him u/s 498A IPC so that from one side you can take him down financially and on the other side (if this kind of cruelty is meted out to you) then IPC takes care of punishment for such conduct.
But now the main thing comes that is time, and your success rate and everything else you are majorly worried about.
Time no advocate can tell you how much it will take
You will loose money to your advocate but you will gain a lot from your husband
Punishment u/s 498A how far you will succeed depends on the Public Prosecutor's skill and your deposition and of course his advocate's cross examination.
So ultimately this becomes a battle of pressurizing. The one who falls first looses first.
