First of all if you are more than one son/daughter of your parents then you all have equal right/share in your mother's share in the property. For this you (along with your sister/brother, if any) have to file a partition suit claiming your mother's share in the property in the competent court of jurisdiction.

Did your mother claim her share? If not, it will be very difficult. Anyway you may try your luck. It was your mother who should have got it registered in her name. Only then you are eligible. Best of luck.

In order to claim a share I'm an ancestral property, your family must be a hindu undivided family. If it is a hindu undivided family, then your mother is entitled to a share in the property which passes on to you after her passing away. In the event that you meet the above criteria and wish to pursue the matter, please book a consultation or a phone call and I can explain the matter in detail.

Aditya
