How to deal with wife demanding unfair maintenance

09-Jun-2023 (In Family Law)
Religion: Hindu My wife left me a month ago without any reasonable reason. Her parents defamed me in front of my family calling me impotent. They asked me to do a test. The test results were negative but they're now refusing to see the reports. My wife and I had a seemingly loving relationship for 1 and a half year and nor once did I get the hint that she would do something like this. Her father behaved insolently with me and my parents. He came to our house and took away my wife's clothes and jewellery. Currently they've lodged an FIR against us and are demanding 18 lacs. It's nowhere near the expenditure they did on the wedding. We are not willing to pay anything more than 7 lacs and we want divorce. If they will not accept this amount, we will take the case to local court. Any legal advice would be helpful. Thank you.

Dear
It is advised that you should file the case of restitution of conjugal rights under Section 9 of the Hindu Marriage Act and do not agree the demands of the other party. Subsequently they may blackmail you . Let them file the case and you deny any allegations of the dowry and other issues in the Court. But appoint a proper Advocate to defend you.

If both of you agree on the amount of settlement i.e. 7 lacs, you both may obtain a divorce by mutual consent. The said divorce can be obtained within a period of one year. However, incase there is no consensus between you two on the amount of alimony, you may perhaps have to fight a case of contested divorce against your wife, which needless to say is a tiresome and long ordeal.

I am sorry to hear of your situation. Unfortunately, such things appear to be prevalent in today's day and age. Please file a complaint at the local police station stating that your wife has left you, they are making unnecessary demands and subsequent to which file a divorce petition in the Court. Please aware that a contested divorce can take a considerable period to settle. In case you require any assistance then please get in touch with my office.
