How do I reconcile with an unwilling husband to save marriage
07-Aug-2023 (In Family Law)
Hi, I am forced seperated from husband who is living with parents on basis of religion conversion.I wasn't given maintenance amd I don't hold a job. I wasn't also given marriage jewels back so I filed a dowry case which is under investigate. However they've applied for AB fabricating several instances of me wantedly leaving my husband which is false and reverse is true.Since we lived abroad,I was brought to parents by inlaws cunningly saying husband will follow after taking leave but never. They even cancelled my return flight. Now again, after I went back alone and reconciled, they brought us both and left me in my parents house. Now I have no contact with husband for 8 months. How to get out of this mess???I just don't want to leave him but want to at least get truth out. Also he hasn't worked for a year now,so cites this reason for not giving any money.In-laws specifically aren't allowing me in their house but keeping him to seperate us.Can I apply for RCR?
You can apply for RCR. In fact you have to do it immediately. Also you must file for Maintenance so that he is constrained to support you under compulsion. If you continue to keep quite, he will simply get on with his life and not bother about you. Do you have a child? Have you thought about filing for a Domestic Violence case against your husband and his family members? If you are in Chennai and need any further assistance then you can contact me.
Yes you can apply for Restitution of Conjugal Rights and move an application for maintenance in the same original petition. More over you can seek remedy for shared accommodation with you husband under the relevant law.
