How can I save my marriage without taking legal recourse

16-Feb-2023 (In Family Law)
I was married in Dec 2015 and I am currently 6 months pregnant. My husband quit his job just before marriage since he was working in another city and did not look for a job after that. I am working and have been taking care of all the expenses. He has been violent, extremely abusive, suspicious and also was having flings with females. We had a fight in November and he left the house after that and did not return. He blocked my calls, his family said they are not aware of his whereabouts. I lodged a missing complaint in the police station and they said he is somewhere in Punjab and is working. My mom spoke to him and he said he does not care for the child and will not come back. I stay alone and do not want the relationship to end. I want to give him one last chance for the sake of my unborn child. However there is no way I can contact him. What are the legal steps in this condition?

Hello
In the very first instance u shall send a legal notice to him if u have proper address of his in subject for residing yourself in the city where u lived....if he fails then u can file a case for restitution of conjugal right..or file maintenance application for ur delievry.

You can file a Petition for Restitution of Conjugal rights along with maintenance for child , once he is in Court you can have detailed discussion on the way ahead. But frankly his traits what you have described you might consider just filing for maintenance for child and compensation for self and let him be away.

You do not want to end the relationship so You can file the Petition for Restitution of Conjugal Rights U/Section 9 of the Hindu Marriage Act 1955 from the Family Court. For issue notice you can give the last resided together address to the Court. If your husband did not get the notice you can get the order from the Court for issue Public Notice after producing the the missing Complaint. In this case your rights as a wife are protected and from the Hon'ble Court your matter will be settled.
