Fraud case on mediator after divorce
10-Sep-2024 (In Family Law)
Arrange marriage. After marriage started mistreating me from first day for dowry. After 1.5 year both parties mutually separated. During this period came to know that Mediator shared incorrect information about job, property & family background. Is there any way i can make a fraud case on them (specifically the mediator)with respect to information they shared with me ? Is there any penalty to accused in such cases? What is the procedure? Don’t want other girl to be mistreated in future by them.
if the case pertains to Delhi then you can file a case of Fraud on all the parties involved in the act including the so called mediator. Since there is mutual separation I believe that no case of maintenance has been filed but please understand that the courts are only providing what is in accordance with law and not what it thinks is justified. Much better if you can explain the matter to some learned advocate who can assist you in the process
In your case, if the mediator shared false information regarding the job, property, or family background, leading you to agree to the marriage under false pretenses, you may have grounds to pursue legal action for fraud or misrepresentation.
You can file a criminal complaint against the mediator and the family. If you have evidence that false information was provided, you can initiate this process by filing a First Information Report (FIR) at the local police station.
After filing the complaint, the police will investigate the case. If they find enough evidence, a charge sheet will be filed, and the matter may proceed to court. If found guilty, the accused can face penalties, including fines or imprisonment, under IPC provisions.
You may also consider filing a civil suit for damages caused due to the misrepresentation, which can include emotional distress and any financial losses.
