Although adultery is no longer a criminal offence in India, there are still some situations where a husband can file a complaint against the adulterer under criminal law. For example, if the adulterer has committed an offence under other criminal laws, such as rape or sexual assault, the husband can file a complaint against them.
You can file for divorce under the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954. Adultery is considered a valid ground for divorce under these Acts.
You may also choose to seek counselling for himself and his wife to address the issues leading to the affair and attempt to save the marriage.
