Complaint has been registered as FIR 42/2024 u/s 493,376,420 IPC
08-Apr-2025 (In Family Law)
The case has been closed on 11-09-2024 without my knowledge, my husband left me in my mother's house without seeing my baby he is there from may 13, 2025 to till now, without knowing this information the case has been closed. And now How to reopen the case? Kindly respond to my concern.
1. Types of Cases Possibly Referred To:
Since the context involves a husband leaving the wife and child, the case could be related to:
Section 125 CrPC (maintenance),
Domestic Violence Act,
Child custody or matrimonial proceedings, or
Criminal case under 498A IPC.
Let’s address the general remedy to reopen a closed case due to absence or lack of notice:
2. What You Can Do (Legal Remedies):
A. File a Petition to Restore the Case (Restoration Petition):
If the case was dismissed due to non-appearance or by default, you can file a Restoration Petition or Application for Recall under:
Section 362 CrPC (with limitations) OR
Under inherent powers of the court (Section 482 CrPC) for criminal matters
CPC Order IX Rule 9 (for civil/family court matters)
In the petition, explain:
You had no knowledge of the closure,
You were not served or properly informed,
The matter affects your rights (like maintenance or custody).
B. Certified Copy of the Order:
Obtain a certified copy of the case order dated 11-09-2024 from the court where it was filed. That will clarify:
Why it was closed
Whether it was dismissed for default or settled
This is essential before drafting a reopening/restoration petition.
C. Refile the Case (If Needed):
If the court does not allow reopening, and your legal rights (maintenance, custody, DV protection, etc.) still need to be addressed, you can file a fresh case citing the ongoing desertion and neglect by your husband.
