Claim of child in father property if his name is not on birth certific

got married under hindu law. Marriage certificate or registration not done . 7 month expecting , due in sep. 1 year of marriage gets over in dec. what is pro con of not writing fathers name in birth certificate. We are staying seperately. No support from husband. His family filed fir against my family to harass. Finally i filed a fir against them for cruelty harasement torture n dowry. Dont see this marriage working. Do not wish to put his name or give any custody or rights to him. But need advice. Will child b able to claim in future from him if he wishes . Passport makin cud b issue if his name on birth certif? Pls guide

If the Husband files for the custody of the child then you will have to contest the said case. Otherwise, it is not required to put the father’s name on the birth certificate, and it will also not cause any problem in applying for the passport of the child.

In this case it seems that, it s a separation and marriage is still intact. Whether marriage certificate was not obtained or it wasn't registered? still it is advised to add / mention fathers name on child birth certificate for further legal recourse.
