In this case your second husband will have to file suit for under guardian and wards act in which you and your first husband will be made respondents. After that you will give your no-objection to adoption by your second husband. After that if your first husband comes and gives NOC then it would be fine otherwise this will turn into a contested suit which most likely will be in your present husband's favour. But still it would have have been better if you had taken an NOC earlier only at the time of divorce.

If you are divorcee and performing second marriage then your second husband have to adopt your daughter which borned out of your first husband. Your second husband have to filed adoption deed from Court. Then you may give second husband name to your daughter after legally adoption . But madam you can not change daughters previous documents which already on your first husband name. In future in daughter school you may submits second husband name. After adoption deed you may applied for gazet for change of name for further official record of your daughter.
