Can i get share in husband's ancestral property after his death

my age 55 my case pending from last 11/2 years in distric & session court sec.18,19,20,21. i m appiont legal adi lawyer. my husband exp. in apr.2016. my financial condition poor. in this case include my mothe in law,she is live ,she live in inherited property.my husband reside ther befor death,that house is my matrimonial home.right now i m stay in rented with my 2 kids one daughter (25)n son(23).we are hindu.i want to right to reside in my share house.

yes wife can have equal share in husbands ancestral property.Ancestral property under Hindu Law is called Coparcenary property, wherein after the 2005 amendment, even the daughters borne in any such Joint Hindu Family will also get their share like the sons. Before the amendment, only male members of the Joint Hindu family were called Coparceners.

yes you can get it since you were come under the class one legal heir of the deceased husband. You can also get maintenance from your father in law as you were not able to sustain your self from your own effort.
