Can any legal action be taken in case wife is sending money to mother?
16-Oct-2023 (In Family Law)
My wife earning Rs 23000/pm but all expenses of family on my head. She send big amount to her mother. As per law he should contribute or not. 2. Without my permission my son she leaves her mother so she can send big amount.
Sir, you cannot take a legal action against your wife for sending money to her mother. As per Bombay High Court Judgements, it is responsibility of daughter also to take care of her parents even after her marriage. She cannot dodge her responsibility towards her parents. It works on similar lines as you have responsibility towards your parents, she has the same.
Now the question arises how much she gives to her mother. This can be mutually discussed between you and your wife. She should be aware that you have an objection that she gives away larger share of her salary to her mother and that its your expectation that she should contribute equally towards her matrimonial house too.
You both can even approach a counsellor in case you find it difficult to discuss with your wife on this topic. This is slightly delicate topic, so initiate it with care.

Facts mentioned by you are limited. However, based on the limited facts I will provide you with an opinion.
If you and your wife both are staying together, then by law there is no compulsion/regulation that she cannot spend for the family or that only you have sent family. Also, there is no restriction on the amount that she can send to her mother. Everything will depend on the arrangement and understanding between you and your wife.
Things will change if there are problems between you and your wife and both of you are living separately.
Regards.

In this case you can send a personal notice to your wife about maintaining the family further if the wife doesn't agree then can file a suit in family court for the maintenance which then wife should pay towards the child maintenance
