Can a Muslim woman claim maintenance under CrPC 125 without divorce

1. Can a Muslim woman claim maintenance under CrPC 125 even while she is still married and not living with her husband and both parties have not remarried? 2. When it comes to Muslim Women Act (which is a special act) and CrPC 125 (which is a common law) , which will hold higher value? 3. Can a husband refuse to comply with CrPC 125 if he does not want to become party to it?
