After Compromise has been reached in 498A. Permanent Bail required?

20-Jun-2023 (In Family Law)
I am booked in UP under 498a,323,504,506,3/4 and compromise has been made through mediation. I have brought back my wife at my rented home. I got a interim bail my question is if the compromise has been made do I still need to take permanent bail. As per my lawyer still I have to take the permanent bail neverthless compromise has been made is it right or wrong. Is lawyer trying to make me fool to extort the money. After compromise what will be the process the case closed or take back. what can be the consequences if my wife again file the case after 1-2 month or year. What caution can we take to avoid such situation.

No need of permanent bail. U have to file a petition in HC for quashing of FIR on behalf of the settlement in mediation and the statement of your wife will be recorded there then the FIR will be quashed. Yes your wife can lodge FIR again but on fresh grounds

Once a compromise has been reached instead of waiting or pursuing bail you should approach the high court and get your FIR quashed. Get a compromise deed drafted and get it signed by your wife you can further include a clause that you have amicably settled the matter and both the parties would not pursue the case further.

Once compromise has been reached you should immediately move for quashing of FIR. Since a compromise has already been reached it is better to finish the case. Complete opinion can be given only upon knowledge of all the facts.
