Whether an affidavit by son on the two names which belongs to father
15-Jun-2023 (In Documentation Law)
I want to purchase a property where the property owner has already died. The property is in his nick name. The person is having all his identification and address documents in his official name. The legal heir, son has given an affidavit on behalf of the deceased father that the late father is having two names and both the persons are one and identical. Whether an affidavit of such kind can be accepted.
Greetings
With the facts that you have given, i donot agree with an affidavit. A proper process of giving an notice in the papers should atleast be followed. The Records should be checked thoroughly.

Yes, such kind of affidavit may be accepted for the only purpose of identifying the owner of the property. However, you should take adequate caution at the narration of the Deed of Conveyance and such affidavit should be mentioned in the Deed in details.
