Regarding Validity Of An Agreement

05-Apr-2025 (In Documentation Law)
The date of notarization of an agreement is before the date of actual signing of the agreement between two parties. Is the agreement still valid and legally enforceable?

An agreement is primarily enforceable based on the intention of the parties and their mutual consent. Notarization is not mandatory for validity unless required under specific laws. If the agreement was signed after notarization, it may raise procedural irregularity, but the core question is whether both parties signed voluntarily with full knowledge. As long as the terms are clear, lawful, and the agreement is duly executed by both parties, it can still be valid and enforceable. However, the discrepancy in dates might be questioned in court, so proper explanation or an affidavit may be required.
