How to correct my mothers name in 10th mark sheet, its mispelt

what can i do my mother name is misspelt in 10th marksheet . my mother name is but in marksheet its amrita sharma . i passed my 10th in 2012 . i was not aware that this misspelling will create a big problem in my life . as i wanted to go abroad for future studies and i want to apply for passport. but without this correction it will not be possible.i talked to the cbse department they are saying that there is only way to file case . IS their is surety that after filing case my mothers name will get corrected .
Procedure for Correction
Approach The Board Office such as CBSE,NIOS,UP Board etc from where you passed out your examination .They will have the prescribe form /format for correction of Name Date Of Birth ,Father Name fill the form.You may have to enclose your original marksheet or certificate for correction
In case of 12/Higher Secondary/HighSchool Marksheet correction can be done on the bases of 10th/Secondary /Intermediate Class Marksheet record .You also have to attach other id Proof such as Driving Licence,Pan Card,Voter ID or Adhaar Card any one or two document which bears correct record such as name spelling ,date of birth etc..Most of the Board also ask for affidavit and there is a prescribed fee for correction of record. Once the correction is done the correct marksheet will be send you by post or in your school as per your Examination Board Authority Norms
If there is a huge time lag you can take a plea that the mistake has been seen recently .There will be no ground of denial for correction of record if you have genuine proves of correction.
In your case since there is a refusal you are only left with an option to file a case for the correction of mother name .
By filing a case the name will get corrected,Its sure.

Rule 69.1 Changes and Corrections in Name

(iii) The Board may effect necessary corrections after verification of the Original records of the school and on payment of the prescribed fee.
(iv) Applications regarding change in name/surname will be considered where such changes have been permitted by a Court of Law and notified in a Government Gazette. In the event of Court of Judicature allowing the change of name of a candidate, the same shall be carried out by the Board after obtaining relevant documents concerning change of name published in an official gazette.
