Will I get financial support from husband for my baby if i separate

Am 28 year hindu women.my husband n has affair with another women.my inlaws n husband r torturing on me.2 years of my married life is hell for me n nw am 5th month pregnant.can i get finance support from my husband for my baby if i seperate from him cause i am unemployee

definitely yourself and your baby can get financial support from your husband by filing a maintenance case against him before the court. though you separate or may not separate you can get financial support.

You may go to your parents house for taking rest and after delivery you may file petition in a family court for maintenance to you and your child. Before going to court you must pursue all remedies like putting the matter before elders and establishing your facing torture and agony and other unhappy things.

You can file a case for maintenance under (i) section 125 of Criminal Procedure Code and (ii) under 'Protection of Women Under Domestic Violence Act for you and the baby after she is born for your financial support even if you are separate ( that you have a cause to be separate because of torture of your husband and in laws).You can also seek compensation in monetary terms for the physical and mental abuse of your husband and your in laws under the Domestic Violence Act. Further you can seek Residence orders also under the DV Act.

Hi,

You can file a petition under Section 125 Cr.P.C. in the jurisdictional family court for claiming monthly maintenance for yourself as of now. Since your baby is still not born, there is no provision for maintenance for future contingencies. As of now, claim for maintenance for yourself and later for your baby when he/she takes birth for his/her maintenance, welfare and educational needs.
