Wife stayed with me for not more than 2 years can I file for divorce

I got married in Dec 2010, wife stayed for about 5 months with me so far in instalments after marriage . mother in law always interferes in every small matter. last time she stayed with me was august 2014 since then no news i lost interest now how should i proceed for divroce. i have a kid. can he stay with me please suggest

Dear sir ,
Yes you have ground for divorce and you can approach , as far custody of child is there have to see all aspect including his age , and relationship with the child etc. , better meet in person or go for online discussion so that better suggestion can be provided , yes or you can contact us for better help .

Dear Querist,
If you want your wife to come back and you want to live with her file a petition for Restitution of conjugal rights. In case if you dont want to live with her file a petition for divorce. Don't give the child as mother is the natural guardian until the age of 5. You can file guardian petition and seek guardian rights for the child.

You can file a case for Divorce and seek custody of the child. You will need to collect all the documents such as marriage invitation, photographs, child-birth certificates etc. and engage a lawyer to file the case.
