Wife not appearing in the court child custody case

19-Dec-2023 (In Divorce Law)
Dear Sir/Madam, Me and my wife have been living separately past couple of years because she is in relationship with someone else. However she is not even letting me meet my child so 7-8 months back I filed child custody case with interim for access of child. My baby is 2 years 4 months old. It has been 5 dates since then she appeared only gor counselling in the start and not a single court date till now. What is the way ahead in this case. Can court grant me interim order without her reply. And What if she doesnt allow me to meet the child even after courts verdict. What will be the impact. Please guide. Well, If she doesn't allow you to meet with the Child, it it the violation of Human rights. Moreover, she cannot do so, if the Court grants Child Visiting Rights to you, otherwise, you can get her prosecuted under the charge of Contempt of Court. Similarly, If a Court grants Child Custody to you by passing a Decree & if she does not let such Decree implemented, then too, you can file Contempt of Court Case.
