Wife is not staying together since 4 years can I file divorce

if wife does not staying since 4 yrs and left her daughter also how to get divorce one side easily. and if any case there before divorce is there any impact to be on that after getting divorce or filing divorce. i meant say whether any one will be release from the previous case or not. Husband falsely involved the prior case and after divorce filing he will remain in that case or to be relief from that case as he throws a challenge.

Divorce can be filed for, no doubt about it. What is the prior case that you have referred to? If it's a 498A case, then the same will proceed independently of any divorce proceedings. Any criminal case can only come to an end with trial and judgement, unless the complainant withdraws or the case is quashed by the High Court.

No impact will to other should . you can file divorce should at this stage . if you want solve prior case you should contest those case properly.
