02-Sep-2023 (In Divorce Law)
We have settlement two times.1. via mediation where we both agreed (i have copy of settlement) but later she refused on that amount and demanding more money ( 1 lakh extra) n2. After 1 month I agreed to pay and we both filed 1st motion in bhopal visidha court and second motion is pending but now again she is demanding more money. In first motion i have given the 30% amount , her family is saying we will return 1st motion money and make new agreement with new demand( 1 lakh rupees extra) now i am not ready to pay extra at any cost.My questions:n1. please suggest what remedies i have to handle this situation and make a pressure on her n2. It is straight forward extortion so what evidence i need to file an fir.3 if i will apply for anticipatory bail then shall i also need regular bail once chargesheet is filed?nnPlease advice

If the settlement is filed in court and she retracts on her word, it is a clear case of contempt of court. There are judgments to the effect that where a party refuses to abide by its undertakings given in the settlement, court can pass appropriate orders towards satisfying the ultimate objective of the settlement. Your query on FIR is not clear, so no answer can be given.

Despite of several attempts if she is not agreeing on settlement amount …then you can only file a suit for recovery in order to recover that amount which was given in the settlement ….apart from that we do not have any more option in this regard ..thank u n b in touch
