When Court Grant Me Divorce Decree And When I Remarry?

 Me and My wife filed joint petition for Divorce by Mutual consent .On Our final hearing (second motion) after six month on dated 3 August 2017 we recorded our statements in courts. So now we are divorced or still married? I want to know now how much time it will take to Court grant me decree? And when I can remarry (exact time limit if any) ? Is it court give us decree in original copy of Xerox and what is certified copy of decree. ?

(1) Recording of statements in second motion does not itself mean the parties are divorced. After recording statements in second motion, a date for passing judgment and decree is given and on this date judgment and decree of divorce is passed.

(2) Only after the passing of the judgment and decree of divorce, parties are free to remarry any person, subject to limitation period of appeal. And limitation period of appeal against the decree of divorce is 90 days. Means, parties have to wait for remarrying till the completion of 90 days since the date of passing of the judgment and decree of divorce.

(3) Next date for passing judgment and decree after the date on which statements were recorded in second motion, is given at maximum one month away. Means, you can get judgment and decree of divorce after approximately one month.

(4) Court Certified Copies are given free of cost to both the parties after passing of the judgment and decree of divorce. These copies are given only one time, for getting any additional copies, parties have to apply to the Copying Section of the Court. Copies given through the Copying Section are not given free of cost. Original Copies of the judgment and decree of divorce are Court Record, they remain in the Court Record forever.

It can only be ascertained only after perusal of the court file that how much time will take your case because the stage of the case only reflects the case file. court will give you original decree not x-rox.
