what should we do if we dont get settlement amount

which step we have do if we dont get maintenance amount after the order of court is court take any legal action against this how much period required for this process

you need to find the partition referring the order where you are not getting the maintenance after the order it will take 3 months and for that you need to consult the advocate and after that you need to file the petition

File an Execution petition in the same court that passed the maintenance order. The court can also issue a warrant to attach the property or salary of the defaulter. If payment is still not made, the court may issue arrest warrant and order civil imprisonment for up to one month for each month of default. Also File a petition for contempt under contempt of courts Act, 1971.

If husband is not giving maintenance amount even after interim maintenance order is passed, then you will have to file an application for distress warrant against the husband. once the distress warrant is issued, the police will arrest the husband and produce him before the court. Husband will have to pay some amount then atleast. in case you require any further legal assistance you may contact me.
