I have been married for 4 years and have a son, from the very beginning my husband's family didn't like me, they were always keen for my jewellery and money, I sensed that and stopped staying with them, it's been 3 years my husband is not paying me anything, and not even bothered for his son, all my expenses and my son where abouts are taken care by my parents, my husband once raised his hand and I have gd for that, I want to get rid of this relationship. You should file a maintenance case for the same wherein you would get relief from the same. If you file divorce your husband will file restitution of conjugal rights and say he doesnt want divorce and will say he will take care of both. Under pressure he will ask for divorce and he will initiate divorce. Detailed discussion is necessary.

You should file a case for maintainance of you and the child. My advise would be for not to file divorce, if you are not willing to get married in near future, as getting divorce and marrying again will extinguish your right to get maintainance from your previous husband. However, your son will continue to get maintainance till 18
