Im hving a girl child of 2.5 yrs living wid my parents from past 7 months. Want to take divorce. This is second marriage of both of us. My spouse has also a male child of 13yrs, living separately with her mother. Husband and his family told before marriage that they have no contact with the ex and her son. But now i discovered that she living nearby and they all r in contact. I feel betrayed and gone through postParton depression. He tak advantage of ths.Beaten sometimes. I wnt mum 2yrs but nw d

Your client can file for divorce on grounds of cruelty (physical abuse, mental harassment, concealment before marriage). She should also file a case under the Domestic Violence Act for protection, residence, and maintenance. Custody of a 2.5-year-old child is usually granted to the mother, so she has a strong claim.

yes you can file for a divorce under section 13 of hma which is a contested case and if you suffered a physical or mental cruelty then you can also file a case under section 13 1a of hma and you can also opt for maintenance also if you want. you can consult us also if you want I can solve your query too
