Married for 5.5 years .. Some issues and now from the past 6 months staying separate .. Marriage not registered. want to know the procedure for divorce?
Are you both agree then procedure is easy & less time consuming .you both have to appear before court & a petition for mutual consent divorce is to be filed. Your case will be registered & you will get six month date for 2nd motion . after six months on filing 2nd motion after your statement recording you will get divorce. To get a divorce, a minimum separation of 1 year is required. Then by mutual consent, it can be dissolved in 6 months from the day of the first motion, I.e, first stage of divorce. But that has to be mutually agreed by both the husband and the wife.

Hi. It depends whether it is a divorce with mutual consent or it would be a contested divorce. If it is a divorce with mutual consent then it will take around 7 months and if it is a contested divorce then it might take few years.
