Want divorce but Don't want wife to make false charges

Hi...am married for approx 28 yrs during which v hv hd frequent cases of loud arguments & fights. I hv decided to end this marriage to ensure peace in both our lives. But my wife does wish to accept divorce and there has no improvement in our daily life. In fact its turned worser over time. I am determined now to end this matter without any further delays. Pls advise procedure in which the wife does not take advantage over our property & finances with false claims during the procedings.

You can file divorce on the ground of crualty. If she decides to contest if may be long drawn process. If she is not gainfully employed, you may be ordered to pay maintanance if she seeks such relief. She won't be eligible to get your property.

You have not stated if you have children or not. Hence no advise about the child custody and maintanance (in can of minor children)

You can file a Divorce Petition before the jurisdictional family against your wife on the ground of cruelty. But your wife has got right to seek share in the property which stands in your name under the provisions of law. You can first issue a legal notice to that effect. I suggest you to contact an advocate of your choice.
