Waiving off Visitation rights in Mutual Consent document

26-Jul-2026 (In Divorce Law)
Hi all, My spouse filed a divorce case in the madras high court on grounds of Adultery 3 years back. We have a 4 year old son. She has no agreed to settle this amicable by filing for divorce on mutual consent. She is insisting on waiving off my visitation rights and guardianship. I have agreed to pay maintenance every month for the child. Can I sign this and later go back to the court in a year to file for visitation rights? Will the court agree?

You should not sign away your visitation or custody rights without fully understanding the legal consequences. In India, the welfare of the child is the paramount consideration. Even if a mutual consent divorce settlement restricts visitation, you may later approach the Family Court seeking visitation or modification of custody arrangements if circumstances justify it. However, the court is not bound to grant it automatically. Before signing any settlement, consult an experienced family law advocate and ensure that your visitation rights are clearly protected in the terms of settlement.

Merely signing a settlement waiving visitation rights does not necessarily bar you from approaching the Family Court later. In all matters concerning a minor child, the welfare of the child is the paramount consideration, and the court retains the power to modify custody or visitation arrangements if circumstances so require. However, signing such a clause may weaken your position. If possible, negotiate for reasonable visitation rights to be incorporated in the settlement itself. If you later file an application seeking visitation, the court will decide it based on the child's best interests and the facts existing at that time.

if you voluntarily sign a settlement giving up your visitation rights, the court will consider that agreement while deciding any future application. You may have to establish that granting visitation is in the child's best interests and explain why the earlier arrangement should be modified. Therefore, if maintaining a relationship with your son is important to you, it is advisable not to waive your visitation rights in the mutual consent divorce settlement. Instead, request that the settlement itself include reasonable visitation rights, such as weekend meetings, holiday access, video calls, or any other mutually agreed arrangement. Please consult your advocate before signing the final settlement deed to ensure your parental rights are adequately protected.
