Under Section 13 of the Code of Civil Procedure (CPC): A foreign divorce decree is NOT automatically valid in India. It is recognised only if certain conditions are satisfied If not, then in India you are still legally married despite UAE divorce. Your UAE divorce will generally be recognised if ALL these conditions are met: (A) Jurisdiction is proper UAE court had jurisdiction (residence, domicile, etc.) (B) Divorce is on merits Not an ex parte or technical order (C) Both parties participated You mentioned your partner participated → this is in your favour

Foreign divorce decrees can be recognized in India only if they satisfy the conditions under Section 13 CPC and are passed by a competent court on grounds recognized under Indian matrimonial law. Since your spouse participated in the UAE proceedings, it may strengthen the validity, but recognition depends on facts of jurisdiction, consent, merits, and due process. You may file a petition before the appropriate Family Court/District Court in India seeking declaration/recognition of the UAE divorce decree. Certified copy of divorce judgment, marriage certificate, proof of participation by spouse, and translated/apostilled documents may be required. If the decree is contested or not on grounds accepted in India, fresh divorce proceedings may be needed in India. Kindly consult with complete documents for proper legal strategy.

A UAE divorce certificate is not automatically valid in India. Its recognition depends on whether it meets specific legal tests under Section 13 of the Code of Civil Procedure (CPC), 1908, which governs the conclusiveness of foreign judgments.
