Validity of remarriage after 90-day appeal period and belated filing

26-Apr-2026 (In Divorce Law)
I secured a divorce decree in my favour. After the 90-day appeal window lapsed, the respondent filed a belated appeal on Day 91. This appeal remained unregistered for 48 days, during which I remarried. The High Court ordered notice on Day 49; I have not yet received physical service. Under the Hindu Marriage Act, is my remarriage legally valid since it occurred after the limitation period expired but before the appeal was processed?

Prima facie, your remarriage appears to be on stronger legal footing, but the matter depends on whether the High Court ultimately condones the delay and grants any adverse findings. Under Section 15 of the Hindu Marriage Act, remarriage is permissible once: - a decree of divorce is passed, and - the statutory appeal period expires without a valid appeal being filed within limitation. Here, the appeal was filed on Day 91, i.e., beyond limitation. Your remarriage took place after expiry of the 90-day appeal period and before the belated appeal was effectively processed/notice served. This significantly strengthens your position. However, if the appellate court condones delay and sets aside the divorce decree, complications may arise, though courts also consider whether the remarriage was entered into bona fide after expiry of limitation. Immediately engage counsel and file a detailed response highlighting: - expiry of limitation, - date of remarriage, - absence of service/notice at the relevant time, and - your bona fide reliance on the subsisting decree. Do not ignore the High Court proceedings. Your remarriage is not automatically void merely because a belated appeal was later entertained.

Your marriage is likely valid, since you remarried after 90 days you acted within the law at the time. Court has held remarriage may become legally vulnerable, but generally bona fide remarriages after expired of limitation are protected.
