Trapped in a Forced Marriage – Need Legal Guidance for Divorce

21-Jul-2025 (In Divorce Law)
I’m a 29-year-old male. My family forced me into marriage 1.5 years ago using threats. I told the girl it was forced, but she agreed. There’s no bonding, I feel mentally disturbed. My family pressures me to stay. I want divorce but fear backlash. Please guide how to start the process safely, keep it confidential, and understand my legal rights.

Hello, If your spouse is willing, you can proceed with a mutual consent divorce, which typically takes around one year to be finalized. However, if there is no agreement, you may opt for a contested divorce, which follows a different legal route and may take longer. To provide you with proper guidance, I will need complete details about your marriage, the issues involved, and any ongoing proceedings. Feel free to share the information so I can assist you better.

You can file for divorce under Section 13(1)(ia) of the Hindu Marriage Act on grounds of mental cruelty, citing being forced into marriage and continued psychological distress. Visit a family court with help from a lawyer, and file a divorce petition unilaterally (contested divorce). Collect proof of forced marriage, emotional trauma, and lack of cohabitation. If family threats continue, consider filing a police complaint or seeking protection. You can also live separately during the case. Court will issue summons to your spouse. If she contests, the case may take longer. If she agrees later, it can be converted to mutual consent under Section 13B. Prioritize your mental well-being and seek counseling or legal aid services if needed.
