Transfer of Divorce Case to another magistrate

07-Aug-2023 (In Divorce Law)
Hello, my friends final hearing of the mutual divorce case filled in the city of Raipur was scheduled for 1st Aug'16. However the magistrate who was suppose to chair the hearing got retired on 30th July'16, causing the hearing to be pushed further with an uncertain timeframe. My question is: "Is it possible for the plaintiff to file an application in the Raipur Civil/ Family court for the case to be transferred to another magistrate in the same court? If yes, what is the process/ steps to be followed." Thank You!

U have to file transfer application to transfer ur xase from one court to another court and has to properly justify valid reasons y u need such transfer. At at the instance of such if the superior court thinks its fit to transfer the case to meet the ends of justice he will definitely transfer to such other court as he thinks. Or u can file transfer petition in supreme court or high court also.
