To file my brother's divorce case.

My brother has filed a case for divorce with his wife. But she is refusing to give divorce, But my brother is not ready to continue his life with her because she is mentally torturing him for luxury life which he can not afford. And always she goes to her mother's home without there in law's permission. And she applies unnecessary allegations on her in law's that they are torturing her and that my sister in law regularly comes home and there is no privacy for us which is not true. Hindu religion

Dear Sir, Your brother may approach High Court for early disposal direction to the family court.   Under Hindu law, if your brother has filed for divorce on grounds such as mental cruelty, desertion, or irretrievable breakdown of marriage, the case can proceed even without the wife's consent. Continuous mental harassment, false allegations, and unreasonable demands for luxury beyond his means may qualify as mental cruelty under Section 13(1)(ia) of the Hindu Marriage Act.
