The Limitation Of Days Count Against Family Court Judgement
20-May-2025 (In Divorce Law)
Hi I got judgement of divorce on 14 april from family court... Just want to know the limitation days to file appeal in high court.... Whether it is 30 days from the date of judgement or it is 90 days..? And whether the days count in vacation of highcourt? Need clarity about this....
Dear Sir,
The law in respect of calculation of Appeal period is not at clarified. As per family Courts Act it is only 30 days to file Appeal. It is 90 days as per CPC and limitation Act provisions. The vacation period will be given exemption while calculating limitation period thus you may prepare appeal better within 30 days from the date of receipt of certified copies of judgment.
