Terminating Parental Rights and Obtaining Sole Custody

05-Sep-2024 (In Divorce Law)
My husband has abandoned both our minor children of ages 14 and 16 since Aug 2022. He doesn't want child custody and is not willing to complete court formalities so that as a mother, I can obtain the sole custody. Please advise under what sections can I file for termination of his parental rights for abandonment and obtain sole custody of both kids? How fast can custody be obtained in this way?

You can file an application for child custody before the Family Court for seeking sole custody of both the children. The Court will grant you their custody but may or may not allow visitation rights to your husband that is father of the children.

You can obtain a sole custody of a child by filing a petition into the family court of law under the guardians and wards act where you have to state why you need the child custody and all the reasons why child's father is not compatible for taking care of the child and upbringing of the child then you may get the sole custody also you can file maintenance under domestic violence act and also if u have filed any divorce petition under that you can ask for the interime maintenance !
