Taking khula, and I want custody of my children..as husband is not

My question is I wanted to take khula, and the reason is my in-laws especially my mother in law, there is always quarrel between us because of my in-laws...we both does not have major problems between us, and my husband doesn't want me to keep in a separate home..it has been 11 years for my marraige but still the reason of our weak relationship is my in-laws..I have two sons age 9 yrs and 5 yrs old, and I m really fed up of my relationship and married life because of my in-laws. Now I want to separate with him and he is not ready to keep our sons with me... please sir help me out, I want my children custody

you have a right to get separated legally and as per sharia. however your husband has to accept khula , if he doesnt accept you can approach court. as far as child custody, there is no rule as to who, i.e. father or mother gets custody all that is significant is minor childs welfare and their wishes.
