Surname change of the child. Mother is sole custody

05-Mar-2026 (In Divorce Law)
Mother has sole and full custody of a 14-year-old daughter, with no maintenance paid by the father. The custody agreement grants the father visitation only with the daughter's consent, and gives the mother full rights over all, including educational and administrative decisions. The mother has not remarried, so the surname change is not to a stepfather's name. Can the mother change the daughter's surname (currently the father's name) without his consent ?

The mother can apply to the surname when the child is in her custody and for the welfare of the child. Consent of the father and court permission if the father objects. If you need more queries please call me.
