10-Feb-2025 (In Divorce Law)
1. I want to bring stay from court against unilateral decision of wife to remove child from high school (nursery class). 2. I need joint custody of child also. What will be total cost of both of aboce procedures. What will be the time taken for final decision in both.

You can immediately move an application before the Court against uprooting the child from one school to another without consulting you. As far as joint custody is concerned, you can seek the same as Courts encourage such practices. Feel free to contact me for seeking any legal advice/assistance as regards the same.

You can file for a stay under Section 26 HMA or the Guardians and Wards Act to stop the child’s removal from school. For joint custody, file under the same Act. Courts prioritise the child's welfare. Cases may take months to years. Kindly share more details so that precise and correct advice can be given.
