Spouse submitting financial disclosures
16-Apr-2026 (In Divorce Law)
My husband doesn't pay maintenance unless enforcement although financially capable and doesn't submit financial disclosures in Family Court since 2019 but now he as a petitioner has filed Testamentary Petition of his deceased father. Can I use this in my case for financial support for me and my specially-abled son
can file an application in the Family Court mentioning this development.
Request the court to:
Take judicial notice of the Testamentary Petition.
Direct the husband to disclose details of the inheritance/assets from his father's estate.
Enhance maintenance amount based on his increased financial capacity.
Impose costs/penalties for continued non-compliance.
Yes, you can definitely rely on that fact. If your husband has filed a Testamentary Petition, it indicates his involvement in inheritance/property matters, which can be used to demonstrate his financial capacity and access to assets. You can bring this on record in your maintenance proceedings to counter his non-disclosure and strengthen your claim.
