Spouse submitting financial disclosures

13-Apr-2026 (In Divorce Law)
My husband has filed a divorce case against pending since 2019. However, he frequently remains absent from hearings, seeks repeated adjournments, and has not complied with court directions to submit his financial disclosures. He has also failed to pay maintenance as per the interim order, except when enforcement action is initiated. He has filed Testamentary Petition for his deceased father's. Can I use this for my divorce case and how

Unless the properties of the deceased father of your husband gets transferred in his name, those properties cannot be considered his property. However, you can always put forth before the same before the Family Court. Feel free to contact me for seeking any legal advice/ assistance as regards the same.

you can appear before a court seeking an application to dismiss the petition if you want the dismissal of the petition filed by your husband on the basis that he has not been appearing before this court however, appearing and filing petitions before various other court. Thereafter you can file a new application seeking dissolution of marriage by showing various grounds and an application under section 125 of crpc for maintenance.

Yes, file application to strike off defence/dismiss petition for non-compliance of maintenance and disclosures. Use probate petition to show assets/income, seek costs, arrears, adverse inference as per the concerned provisions of law.
