Sir/Madam can DVC case be filed after 494 case on my husband, and I collect all proofs of second marriage because my husband done second marriage without divorce I filed 494 bigamy case and now I want to file DVC because I do not want file divorce my husband tortured me so much my children also suffering from my husband so when ever my husband give compensation then I will give him divorce. Please suggest me sir what I do now .................................................................

Yes...you can anytime file a petition under the DV Act and in that only you can claim your monthly maintenance from your husband. And as far as the 494 case is concerned the second marriage will be declared as void if your husband is legally married to you. You can also file a separate petition under section 125 CrPC to claim your maintenance. For more legal assistance I am just a call away.

Yes, definitely you can file the domestic violence case against your husband. But before filing it make sure you are able to prove that you were residing in a shared household of your husband or else your case won't stand. For more details you may consult me.
