Concealment of previous marriages by your wife amounts to fraud, misrepresentation, and suppression of material facts, which vitiates the marital consent. You are entitled to seek annulment of marriage under relevant matrimonial laws or file for divorce on the grounds of fraud, cruelty, and adultery. The allegation of adultery, though decriminalized, continues to be a recognized ground for dissolution of marriage. In respect of false criminal cases filed against you, you may contest them by producing documentary and circumstantial evidence, and if baseless, move for quashing before the High Court. Additionally, remedies for perjury and malicious prosecution can also be explored. You also retain the right to claim custody, guardianship, or visitation of the child under the Guardians and Wards Act. Immediate consultation with a family court practitioner is advised so that a comprehensive petition can be drafted safeguarding your legal rights.
