A wife cannot directly obtain her husband’s bank statements or personal financial records through RTI, as such information is treated as “personal information” and is exempted from disclosure under Section 8(1)(j) of the Right to Information Act. Banks are fiduciary institutions and cannot disclose account details to third parties without consent or a valid court order. However, in matrimonial or maintenance proceedings, the court has the power to direct disclosure of income, assets, bank accounts and financial documents. You may file an application before the concerned Family Court seeking direction to the husband to submit an affidavit of assets and liabilities along with supporting documents. Courts routinely pass such orders to ensure fair determination of maintenance, alimony and financial rights. Therefore, the proper legal remedy is to approach the court and seek disclosure through judicial process rather than RTI. This will be legally valid and enforceable.

No, a wife cannot obtain her husband’s bank statements or personal financial details through an RTI application, as banks are not required to disclose third-party personal information under the RTI Act due to privacy protections. However, in matrimonial or maintenance proceedings, she can request disclosure of income, assets, and bank statements through the court by filing an appropriate application. The court has the power to direct the husband to produce financial documents if relevant to the case.
