Separation on ground of extramarital affair

My huseband is having extramarital affair,but he is not accepting it,I have my baby of 7 months,if I ll leave his house without any legal action,how can I claim maintenance from him?
hello mam you can file a divorce petition section 13 Hindu marriage act and you can file a CrPC section 125 maintenance then you can file according to Hindu marriage act section 24 25 maintenance and for the you can file FIR for section 420 406 498 a and you can file an FIR domestic violence act 2005

First you should evidence of extra marital affair of your husband. If you have this then you should sui of Divorce against your husband. Second if you have not any evidence then you should lodge a F.I.R. against your husband for demanding of dowry and physical and mental cruelty.
