Separated from 3 years how can I apply for divorce

I am in a 4 year long marriage. Out of which 3 years were in distance. As an individual I have moved on away from the partner and m not able to respond in the same manner. Whilst during distance we had a lot of fights and bitterness and misunderstandings. I had given up on this marriage couple of months back. But my husband insisted we should try again while we live together. I just cannot be in this marriage anymore. I have evolved and m a different individual now. Talking about divorce isn't going to help as he gets cry baby.

no person can take advantage of his/her own wrong, please let me know whether on your own violation left the matrimonial home or you were thrown out, what is the nature of differences in between you and your husband

since your are residing Separately for 3 years you can maintain petition for divorce if your mariage has reached to a point of no return but as you said that your husband want for one more change if so i think you should give the same at least for the of your elders

As a first step i suggest you to talk to your husband on the issue of obtaining divorce. if he does not agree for the same then it is better to file a contesting divorce petition before the jurisdictional family court by claiming your permanent alimony amount.

You can file a case for Divorce and contest it in the jurisdictional court. Alternatively, you also approach the Mediation Center and seek pre-litigation counseling. Bangalore Mediation Center offers this. A mediator will counsel and help you set aside your differences. Even if after that your husband does not agree for divorce by mutual consent, then you can file a case from your end.
