There is no legal restriction on issuing a legal notice to your husband even if you have been living separately for only 6 days. A legal notice is merely an intimation of your intention and grievances, and it can be sent at any point of time. However, for filing a divorce petition under the Hindu Marriage Act, 1955, mere short-term separation is not a sufficient ground unless supported by legally recognized grounds such as cruelty, adultery, or desertion. At this stage, issuing a legal notice can strategically help in formally putting your grievances on record, calling upon your husband to respond, and clarifying your intent regarding continuation or dissolution of marriage. It may also open the possibility of an amicable settlement or reconciliation, while simultaneously creating documentary evidence that can be relied upon in future litigation. If you have faced cruelty, harassment, or domestic violence, you are not required to wait for any specific period and can initiate appropriate legal proceedings immediately under the relevant provisions of law. It is advisable to draft the notice carefully, mentioning all material facts, as it may be relied upon during subsequent proceedings before the Family court.

You can send a legal notice for divorce at any time as there is no minimum separation period required for issuing a notice; however, for a mutual consent divorce, the law generally requires that both spouses live separately for at least one year before filing the petition, so since it has only been 6 days, you cannot file for mutual divorce yet, though if you have valid legal grounds such as cruelty or harassment, you may proceed with a contested divorce even at this stage.
