Seeking Legal Help to Declare Symbolic Marriage as Invalid

26-Jun-2025 (In Divorce Law)
In December 2024, a symbolic ceremony was done at a private hall in Alandi, Pune, but there was no proper Hindu ritual[ like saptapadi , homehavan] , no priest, and no legal marriage registration. Later, the girl told me she had a past relationship and clearly said she doesn’t want to marry — I have this recorded on video. I want to file a case to declare that no legal marriage happened. I have proof and just want to close the matter legally, with no further involvement.

As an advocate, Under Indian law, particularly Hindu Marriage Act, 1955, a marriage requires the performance of customary rites and ceremonies of either party, which typically include saptapadi and homam, along with the intention to enter into a matrimonial union. The absence of these essential rituals, a priest, and formal registration, as described, strongly indicates that no valid Hindu marriage took place. Your video recording of the girl's clear declaration of not wanting to marry further substantiates the lack of matrimonial intent, which is crucial for a legal marriage. Therefore, you can file a petition for a declaration that no legal marriage ever occurred, presenting your evidence to the court to formally close the matter.

As an advocate, Your query, concerning the purported marriage in December 2024, indicates a strong case for seeking a declaration of nullity. Given the absence of essential Hindu marriage rituals such as saptapadi and homam, the lack of a priest, and critically, the non-registration of the marriage, it can be argued that no valid Hindu marriage, as per the Hindu Marriage Act, 1955, ever took place. The video recording where the girl explicitly states her unwillingness to marry further strengthens your position that there was no free consent, a fundamental requirement for a valid marriage. You can file a civil suit for a declaration that no legal marriage exists between the parties. This will legally close the matter without further personal involvement.

If you want to get out of this legally then you need the girl to state so clearly to you in writing that she is not married to you. Feel free to contact me for seeking any legal advice as regards the same..
