SECTION 9 IS APPLIED BY HUSBAND AND IS PENDING IN COURT WIFE IS NOT RESPONDING, CAN HUSBAND APLLIED FOR DIVORCE WHLIE SECTION 9 IS STILL PENDING

No you have to withdraw the sec 9 application first,, then file for a contested divorce. If order is passed u/s 9 and the wife doesn't respond to it, you can go and file for divorce under which shall be exparte incase wife doesn't come to contest it

Dear queriest, if section 9 is still in existence then the husband cannot file divorce, since he is asking for restitution henceforth he cannot file for divorce. for more information about the same kindly call me.
