19-Jan-2026 (In Divorce Law)

Under Section 14 of the Hindu Marriage Act, divorce within one year of marriage is barred. However, the court may grant leave if exceptional hardship to the petitioner or exceptional depravity by the respondent is proved. Mental cruelty, serious harassment, abandonment, or grave circumstances must be specifically pleaded and supported by evidence. If leave is granted, the divorce petition can be entertained before completion of one year.

One year separation (mandatory condition) Husband and wife must have lived separately for at least one year before filing the petition. “Lived separately” means not living as husband and wife, even if under the same roof. This one year is counted before filing the first motion petition. 2. Six months waiting period (cooling-off period) After filing the first motion, the court gives a minimum waiting period of six months before the second motion. This period is meant to allow reconciliation.
